Fed Ordered To Pay In ATC's Negligence Which Result In The Death Of Pilot
Miami, Florida District Court Judge Edwin G. Torres has ordered the Unites States to pay the family of Michael Zinn, 52, $4.4 million as a result of a Miami's Air Route Traffic Control Center air traffic controller's negligence which was partially the cause of Zinn's death when his airplane crashed back in October 2005. Sad event, but I do agree with the pilot's bad judgement. He should have known about the convective weather...or at least a possiblity of it, and cancelled or delayed the flight.
While not the best outcome, this could result in more proactive handling by ATC.

Often a GA flight will get vectored into bad weather while Air Carriers and being routed around it.

I don't understand. We were all taught on how to plan a flight VFR or IFR. I think the controller could have been more proactive in handling the Skymaster, but the pilot should of anticipated these thunderstorms along the route. Come on, Florida,afternoon thunderstorms calls for a lot of deviation, weather radar, a lot of fuel and forsight, especially flying this type of airplane.
Look for this to get reviewed by the higher courts as this judge is a Federal Magistrate (lowest level) and the Feds have lots of our tax money to spend. I doubt the FAA will want this as a precedent to shift liability to them as the deep pocket outlet for bad judgment.
